(Westchester, NY) Congratulations to the Practus’ New York IP team. They scored a big trial victory in the Southern District of New York in a trademark dispute lasting more than three years. After defeating an early attempt to dismiss the case and then a motion for summary judgment, partners Jeffrey Lindenbaum and James Hasting, with an assist by Partner Jess Collen and legal assistant Frank Morea – as well as NYC based partner Chris Colvin – prevailed at trial. They secured a favorable judgment and rigorous permanent injunction.
Notably, they overcame a strongly litigated laches defense, notwithstanding an alleged delay of over a decade. By building a record of the Defendant’s bad faith, the team successfully argued that this conduct barred the equitable laches defense, and fully excused any delay. (A laches defense is a legal rule allowing a court to throw out a plaintiff’s claim because they waited too long to file it, causing unfair harm or disadvantage to the defendant.)
The team also defended a challenge to the claim that the client had used the trademark prior to the Defendant. They prepared the trial witnesses to present compelling testimony that ultimately led to a favorable finding that Plaintiff was the prior and proper owner of the trademark.
