RELEVANT EXPERIENCE
Linda is a member of the Privacy & Cybersecurity faculty of the Fordham University Masters of Studies in Law and a certified European Information Privacy Professional (CIPP/E) through the International Association of Privacy Professionals (IAPP). She is a member of the ABA Cybersecurity Legal Task Force and former Co-Chair of the ABA International Law Section Privacy, Cybersecurity & Digital Rights Committee. Prior to joining Practus, Linda worked as a partner at Culhane Meadows PLLC where she was Chair of the Data, Privacy, and Cybersecurity Practice Group and Co-Chair of the Government, Regulatory, and Compliance Practice Group. She served as Deputy General Counsel and Agency Ethics Official at the White House Office of Drug Policy (ONDCP) 1999-2013 including children’s privacy, digital and social media compliance, and class action and U.S. Supreme Court litigation. Prior to ONDCP she was Acting Legal Director at the Bazelon Center for Mental Health Law in Washington DC; Assistant Utah Attorney General for Indian Affairs; Member of the Utah State Solid and Hazardous Waste Control Board; and attorney in private practice representing Indian Tribes in environmental and natural resources litigation.
REPRESENTATIVE MATTERS
- Legal advice to international companies/organizations on creation and day to day operation of EU/EEA/UK-U.S. data privacy/protection/security compliance program policies, procedures, and practices under the EU/EEA/UK GDPR, California CCPA/CPRA, EU-U.S. and Swiss-U.S. Privacy Shield, and CJEU Schrems II, including privacy by design/default, and mergers and acquisitions.
- Draft and negotiate over 500 EU/EEA/UK GDPR and U.S. data privacy/protection agreements/addenda with vendors, business partners, customers, and company subsidiaries and affiliates on behalf of technology companies including software as a service, computer equipment manufacturers, software and mobile application developers, ad tech service providers and digital advertisers, due diligence service providers, employers, government agencies, industry associations, and charitable organizations.
- Create data privacy/security compliance program for new municipal government agency.
- Represent U.S.-UK international non-profit industry association before U.S. Department of Commerceobtaining EU-U.S. and Swiss-U.S. Privacy Shield Certifications for employee HR and non-HR data.
- Advocacy on behalf of foreign corporation before U.S. Department of Commerce obtaining waiver of reporting requirement.
- Advice and counsel to digital and social media advertisers and marketers, internet retailers, employers, federal contractors, and law firms regarding compliance with EU, U.S. and state laws governing use of social media in business and the workplace and data privacy/security.
- Management of White House Drug Policy ethics program including Senate-Confirmed Presidential Appointments and public financial disclosure report filers.
- Advice and counsel regarding ONDCP social and digital media policies, procedures, and practices.
- Preparation of ONDCP Presidential Appointees for Congressional, court, media, and public appearances and drafting Statements of Administration Policy.
- Volunteer advocacy before U.S. government agencies and offices including White House Office of Science and Technology Policy, Coast Guard, State Department, Department of Commerce, and Navy on behalf of underrepresented stakeholders in the U.S. Arctic regarding U.S. and international policy on business in the Arctic including sustainable energy, tourism, shipping, environmental and species conservation, risk management and emergency response, stakeholder engagement, community impact, and data privacy/protection/security.
- White House Drug Policy Counsel in over a dozen U.S. Supreme Court cases including Safford Unified School District v. Redding, 557 U.S. 364 (2009).
