Kevin Kercher’s relevant industry experience spans a wide array of sectors, including robotics, engines and turbines, fintech, blockchain, medical devices, biotechnology, aerospace, agricultural minerals and equipment, amusement and gambling devices, pharmaceuticals, textiles and apparel, automotive components, entertainment, chemicals, computers, construction equipment, educational and research services, appliances, electrical power equipment, food and beverage ingredients, containers and processing equipment, molding equipment, plastic and elastomer technology, government, oil and gas extraction, floor covering, military products, HVAC and refrigeration, jewelry, banking, publishing, exercise equipment, retail, telecommunications, investments, and data centers. This diverse background demonstrates Kevin’s ability to navigate complex technical fields and apply his expertise in intellectual property law to a broad spectrum of industries.
In addition to his extensive industry experience, Kevin has significant technical expertise in preparing and prosecuting complex patent applications in various fields, including computer software and hardware, electronics, electromechanical systems, mechanical engineering, and chemical arts. His legal practice covers all areas of IP law, such as patents, trademarks, copyrights, trade secrets, government contracts, due diligence, and portfolio management. Kevin has a strong track record of success before the U.S. Patent and Trademark Office, including oral arguments and reversing rejections through the appeals process.
Kevin also has substantial experience preparing and negotiating technology agreements, such as licensing, joint development agreements, and government contracts, with a focus on IP provisions. His leadership skills are evident in his recruitment, development, and management of legal teams of up to 10 professionals, ensuring effective collaboration and high-performance results across diverse projects.
Kevin represents a client who was celebrated for inventing a self-tuning piano on NPR and two clients who won the St. Louis Bar Association Inventor of the Year for a noninvasive glucose detector (developed global patent portfolio) and for utilizing blockchain to manage resources in a commercial building, respectively. Experience with drafting and prosecuting AI, blockchain and cybersecurity patent applications.
Kevin drafted and negotiated all types of intellectual property agreements with an emphasis on licensing with parties located throughout the world. Currently chairs the High Technology Sector for the Licensing Executives Society. Also, Kevin has provided detailed analysis in the areas of government contracts, due diligence, unfair competition, and trade secrets involving intellectual property and drafted noninfringement opinion letters, product clearance analysis, and patent invalidity analysis.
Kevin has developed extensive knowledge regarding the transfer of technology from educational or research institutions to corporate entities. Moreover, Kevin has I made presentations in China at the International Technology Fair UNIDO Day and the Global Investment Forum at their request, and drafted and negotiated numerous agreements involving media and entertainment law.
