For more than 22 years, Knicole Emanuel has maintained a health care litigation practice, concentrating on Medicare and Medicaid litigation, health care regulatory compliance, administrative and regulatory law, including HIPAA and cybersecurity with electronic medical records. She defends health care providers against post payment reviews, prepayment reviews, suspension of reimbursements, allegations of fraud, False Claims Act, Anti-Kickback, HIPAA, and other regulatory and cybersecurity issues. Knicole has successfully obtained federal and State preliminary injunctions Staying Medicare and Medicaid terminations and suspensions of reimbursements. She successfully defends long term care, nursing homes, and residential facilities when regulatory penalties or summary suspensions are implemented. She has litigated against RACs, MACs, UPICs, CERTs, TPE audits until, in many cases, the provider prevailed, owing nothing. She understands the intricate Medicare and Medicaid payment system, the unique business of healthcare providers, the overlay of federal and state Medicare and Medicaid rules and regulations, and actions of State agencies that affect the way health care entities operate.
Knicole has tried over 3,000 administrative cases in over 43 States and has appeared before multiple States’ medical boards. Knicole has successfully obtained federal injunctions in numerous States, which allowed health care providers to remain in business despite the allegations of health care fraud or abhorrent billings based on data mining. Across the country, Knicole frequently lectures on health care law, the exceptions due to COVID and regulatory compliance for providers, including physicians, home health and hospice, dentists, chiropractors, hospitals and durable medical equipment providers. She is a weekly panelist on RACMonitor, a national podcast, as a national expert on Medicare and Medicaid audits.
Knicole lives on a horse farm with her family, spending her time trail riding on her Tennessee Walkers. Her family also drives side-by-sides and four-wheelers.
